India Published Toys (Quality Control) Order, 2020

On 26 Feb. 2020, the India Ministry of Commerce and Industry published Toys (Quality Control) Order, 2020, which will be effective on 1 Sep. 2020. The order applies to: 1) Toy Product or material designed or clearly intended, whether or not exclusively, for use in play by children under 14 years of age or any other product as notified by the Central Government; 2) Toys as they are initially received by the children and, in addition, this shall apply after a toy is subjected to reasonably foreseeable conditions of normal use and abuse unless specifically noted otherwise.

The Order contains several important provisions for toy safety:

All toys shall meet the requirements of the latest version of the Indian standards listed in table 1.
All toys shall bear the Standard Mark under a licence from the Bureau as per Scheme-I of Schedule-II of BIS (Conformity Assessment) Regulations, 2018, as shown below.

The Bureau shall be the certifying and enforcement authority for toys.

For the purposes of Table, the latest version of Indian Standards including the amendments issued thereof, as notified by the Bureau from time to time, shall apply from date of such notification.
